Data Protection
The litigation and dispute resolution team have extensive experience in the area of data protection. The team advises a range of clients including public sector and private sector bodies on their legal obligations in respect of data protection legislation.
Our areas of experience include:
- Advice in relation to compliance with the Data Protection Acts for data controllers and data processors, including registration obligations.
- Advice in relation to the retention and storage of information and records.
- Advice in relation to the processing and use of data by data controllers and data processors.
- Advice in relation to disclosure obligations for data controllers and data processors upon receiving an access request from a data subject.
- Advice in relation to transfer of data outside of the European Union and in particular the transfer of data to the US and the requirement that the US company is certified as Safe Harbour compliant.
- Regular advice to clients on data protection issues, including work place policies, employee monitoring, privacy policy, email and SMS marketing.
- Advice in relation to obligations of our clients under the Freedom of Information Act 1997 and the Freedom of Information (Amendment) Act 2003 and advice in relation to freedom of information requests.
