EU & Competition

In the current climate Landwell understands the necessity to provide advice on all aspects of EU law, particularly in relation to the area of Competition law given the heavy penalties, both personal and monetary, for non compliance both at a national and EU level. We also advise clients in relation to dealings with the Irish Competition Authority (the 'CA').

We advise on matters such as:

Under the Competition Act 2002, the CA is responsible for the control of mergers and acquisitions. Landwell can provide advice and draft documentation regarding mandatory notification by the merging parties to the CA, the relevant company turnover thresholds and whether the company will be considered to be 'carrying on a business' for the purposes of the legislation. We also have experience with regard to investigations by the CA and "dawn raids".
