Landwell has a highly respected and experienced team working in the area of Public Law and advises clients on all the legal issues arising from administrative law and procedures including procurement and tendering advice. Due to the increased importance of inter-European trade there is greater need than ever to be aware of Irish and European public procurement rules. Our team has extensive knowledge of all relevant areas of EU and Irish law in order to provide the most pragmatic, timely and individual advice to our clients. Our experience includes:
- Advising public bodies on whether national or EU procurement law applies, the appropriate choice of Directive and the choice of award criteria;
- Advising public bodies generally on the procedure to be followed under the National Guidelines ("Green Book") (1994 and 2004) and related issues including those arising under the Government Guidelines for State Bodies (1992), the Code of Practice (2001) and Circular 02/40 from the Department of Finance;
- Advising clients who are being investigated by various bodies including the Director of Corporate Enforcement, Revenue Commissioners, Data Protection Commissioner and the Competition Authority;
- Advising regulated authorities in carrying out investigations, including the training of authorised persons;
- Advising individuals, company operators and regulatory authorities on all aspects of regulation and in respect of their dealings with regulators when they become subject to scrutiny from Regulatory authorities across varied sectors including Telecommunications, Postal, Electricity, Aviation, Health and Roads;
- Advising clients on their information entitlements under Irish and EU Public Procurement Law and other legislation including the Freedom of Information Acts and the Data Protection Acts;
- Acting for regulators responsible for the regulation of certain markets, in particular Telecommunications, Postal, Electricity, Aviation, Health and Roads;
- Drafting regulations and drafting documents for public and private competitions for Utility Licenses and drafting Utilities Licences including Telecoms (Fixed and Mobile, 2G and 3G), Electricity (Generation, Conveyance and Supply) and Postal Services;
- Representation of either Regulators or Operators before specialist Appeals Panels; and
- Advising government departments and regulatory bodies both domestic and foreign on a broad range of regulatory issues including providing advice on regulatory accounts and on the European Telecoms Framework Directives.
